CIB also fulfils its obligation to make improvements by making updates with an automatic installation routine available for download on its homepage and by offering the user telephone support to solve any installation problems that may arise.
3. The User is obliged to notify the Licensor of any defects in the Software in text form immediately after its discovery. In the case of material defects, this is done with a description of the time at which the defects occurred and the more detailed circumstances.

§ 7. Fee-based technical support
1. All free license versions listed in § 1 (1) of these Terms of Use do not include free technical support. Technical support is any consulting activity that goes beyond a mere shortage of defects, esp. Support in the operation of the CIB pdf brewer.
2. Users who need technical support can either conclude a separate support contract with CIB or make use of individual support units for a fee. The details of the technical support offered can be found on https://www.cib.de/en/support/.
3. If, in exceptional cases, free support is nevertheless provided on a voluntary basis, this is done under exclusion of warranty. CIB may terminate or suspend technical support for a particular product at any time.
4. Before receiving support services, it is your responsibility to back up all of your existing data, software products, and programs.
§ 8. Liability
1. CIB is liable without limitation
- in the event of intent or gross negligence,
- for injury to life, limb or health,
- in accordance with the provisions of the Product Liability Act, and
- to the extent of a warranty assumed by CIB as well as fraudulent concealment of defects.
2. In the event of a slightly negligent breach of an obligation, CIB shall be liable insofar as the obligation is essential for the achievement of the purpose of the contract (cardinal obligation). The amount of liability is limited to the damage that is foreseeable and typical according to the nature of the transaction in question here.
3. Liability for loss of data is limited to the amount of effort required to restore such data if backup copies have been made. They are obliged to regularly carry out data backups in accordance with the state of the art.
4. CIB is not liable for any further reasons. In particular, CIB is not liable for initial defects (§ 536a para. 1 BGB), unless the requirements of paras. 1, 2 are met.
5. In the case of licenses provided free of charge, CIB is only liable for intent and gross negligence, for injuries to life, limb or health, as well as fraudulent concealment of defects.
6. The above limitation of liability also applies to the personal liability of CIB's employees, representatives and bodies.
§ 9. Indemnification
1. You will indemnify CIB, CIB's parent and subsidiary companies, affiliates, and directors from any and all claims, including claims for damages, against the other users or other third parties, including public authorities, against CIB for any violation of these Terms of Use; or your violation of any law or the false, fraudulent, malicious or misrepresentation of your identity.
2. The User shall bear all reasonable costs, including reasonable costs incurred for legal defense, incurred by CIB as a result of an infringement by the User of the rights of other Users or third parties. All other rights of CIB, in particular to extraordinary termination as well as claims for damages of CIB remain unaffected. The user has the right to prove that CIB has actually incurred lower costs.
3. The above obligations only apply to the extent that the user is responsible for the infringement in question, i.e. to the extent that he has committed it knowingly or intentionally or has disregarded the care required in traffic.
§ 10. Term, Automatic Renewal and Termination
1. If you gain access to a right to use the CIB pdf brewer ("License"), you will be granted a license to the applicable Product for a specified period of at least one (1) month ("License Term"). Unless otherwise agreed, the license term begins as soon as you have gained access to the respective product (e.g. via a software key). The duration of the initial license term is specified in the order process.
2. If neither party terminates the Agreement at least 14 days prior to the end of the then-current License Term, the License Term will be automatically renewed for another License Term at the time of renewal at the list price of the Product for the applicable License Term. With regard to the adjustment of prices, see also § 12 para. 2 of these Terms of Use.
The duration of the additional license term is the same as the duration of the initial license term and the following applies:
- the automatic renewal of the license term for at least one (1) month is binding.
- In the case of automatic renewal for a term of more than one (1) year, you have the right to terminate the Agreement with immediate effect and without giving any reason in text form (e.g. e-mail) after the end of this first year of the renewal period.
3. In addition, the license agreement can be terminated in writing by either party without observing a notice period for good cause. An important reason that entitles CIB to terminate the contract exists in particular if you violate CIB's rights of use by using the software beyond the extent permitted under this contract and failing to remedy the infringement within a reasonable period of time following a warning from CIB.
4. The cancellation must be made in text form, stating the license key.
§ 11. Obligation to Return Contract Software
1. Upon termination of the Software Rental Agreement, you must completely delete the downloads of the Contract Software and all copies thereof. You will confirm the deletions in writing to CIB after they have been carried out at its request.
2. You may not continue to use the Contract Software in any way after the termination of the Software Rental Agreement. CIB has the right to block license(s) after termination of the contract.
§ 12. Rent, Due Date and Default
1. The current prices stated on the CIB website apply. All prices are in euros and include VAT. Unless otherwise stated, the prices refer to the respective software products shown on the Internet pages, advertisements and catalogues in accordance with the corresponding description – subject to errors and printing or typing errors.
2. After the expiry of the first minimum term, CIB may adjust the license price in writing or in text form to compensate for personnel and other cost increases or cost reductions with a notice period of 3 months before it takes effect. In this case, you can cancel the contract within a period of 6 weeks from the announcement of the price increase in CIB Cash or in text form.
The adjustment may be carried out annually at equitable discretion after the expiry of the first minimum term if:
- the consumer price index for Germany published by the Federal Statistical Office has increased or decreased by more than 5 percentage points since the last price adjustment. The size of the increase is based on the increase in the consumer price index, or
- increase or decrease the costs relevant to the price calculation as a result of circumstances beyond CIB's control, in particular if the statutory non-wage labour costs increase; New legal, regulatory or technical requirements, new security regulations or new data protection requirements lead to increased or reduced costs of service provision.
3. The payment methods explicitly stated on the CIB Cash website or on the respective invoice for your purchase apply.
4. You will be in default without further explanation from CIB if you have not paid within 30 days of the due date and receipt of the invoice. If you are in arrears with the payment of CIB products, CIB may charge the statutory default interest on all outstanding amounts in accordance with the statutory provisions. The default interest for entrepreneurs is nine percentage points (9%) above the applicable base interest rate. In addition, in the event of a delay, CIB may withhold delivery of the CIB Product(s) together with appropriate updates and/or upgrades (as defined in the Terms).
5. A set-off by you is excluded, unless your counterclaim is undisputed or legally established.

2. The Terms of Use do not create any rights for the benefit of third parties. If you do not comply with the Terms of Use and CIB does not take legal or extrajudicial action against you, this does not mean that CIB waives its rights.
3. These Terms of Use are governed by the laws of the Federal Republic of Germany to the exclusion of the Convention on Contracts for the International Sales of Goods (CISG). If you are a consumer habitually resident in the EU, the mandatory consumer protection regulations of your country of residence also apply.
