Preamble
These Terms of Use exclusively govern the contractual relationship between you (hereinafter "you" or "your") and CIB software GmbH ("CIB") regarding the use of the CIB pdf brewer add-ins and plug-ins for Microsoft 365 and Office products. Separate terms and conditions apply to the use of the "CIB pdf brewer" product, which must be viewed and accepted separately by you.
These Terms of Use constitute a legally binding agreement between you and CIB software GmbH (hereinafter referred to as "CIB"). By using the CIB pdf brewer add-ins and plug-ins for Microsoft 365 and Office products, you accept the terms set forth herein. We recommend that you read these Terms carefully before using them. If you represent another person, your acceptance also confirms that you are entitled to enter into legally binding contracts for that person.
1. Subject matter of the contract and scope of application
1. The subject of the contract is the provision and use of CIB pdf brewer add-ins and plug-ins that enable PDF creation from Microsoft applications (e.g. Word, Outlook).
- Plug-ins for the desktop version of some Microsoft 365 or Office products are activated directly in the installed CIB pdf brewer. They can be activated, deactivated or configured in the settings of CIB pdf brewer.
- For the web version, CIB provides add-ins (e.g. the Outlook Web Add-In) free of charge, which can be downloaded from the Microsoft Marketplace (AppSource). After installation, the Outlook add-in allows you to communicate directly with the installed CIB pdf brewer.
2. The add-ins and plugins can only be used in conjunction with the CIB pdf brewer. For information about the product and how to download it, see https://www.cib.de/pdfbrewer/

2. Conditions and restrictions of use
1. Use is permitted only under these Terms, the Microsoft Commercial Marketplace Terms of Use https://learn.microsoft.com/de-de/legal/marketplace/marketplace-terms), and applicable laws.
2. Misuse, manipulation or circumvention of technical protection measures of the add-ins or plug-ins are not permitted.
3. Use of the add-ins or plug-ins outside the Microsoft interface or for purposes not intended is prohibited.
4. No transfer of rights to intellectual property rights of CIB or third parties; Brand names, logos and legal notices may not be removed or altered.
3. Granting of Rights
1. You are granted a non-exclusive, non-transferable and non-sublicensable right to use the Add-ins and Plug-ins during their availability by CIB.
2. Use is limited to use in Microsoft 365/Office environments.
3. Disclosure to third parties, duplication, sale, rental or making available to the public is prohibited.
4. Updates and Changes
1. CIB reserves the right to modify the add-ins and plug-ins, to discontinue their provision or to adapt functions to the Microsoft products at any time without any claim to continuation or specific functions.
2. Users will be informed in good time of any significant changes, as far as possible.
5. Data protection
1. When using the CIB pdf brewer add-ins and plug-ins, personal data may be processed, such as usage statistics and technical status data. CIB is committed to complying with European Union data protection laws (in particular the GDPR).

3. The Microsoft Privacy Statement, available at Microsoft Privacy Statement, apply to data processing by Microsoft.
6. Liability and Warranty
1. CIB does not warrant the availability, compatibility or accuracy of the Add-ins and Plug-ins.
2. Use is at your own risk. To the extent permitted by law, CIB's liability for slight negligence is excluded, except in the case of injury to life, limb or health and in the case of claims under the Product Liability Act. For damages that are not based on gross negligence or intent, we are only liable to the extent provided for in mandatory statutory provisions.
7. Term and Termination
1. There is no time limit on the use of the free add-ins and plug-ins, but CIB may terminate, modify or restrict the provision at any time.
2. With the cessation of the offer or in the event of material breaches of contract, the right of use ends immediately; all components and any backup copies must be deleted.
8. Amendment of the Terms of Use
CIB reserves the right to change these Terms of Use at any time. Changes will be published on CIB's website and will come into force upon their publication. If you do not agree to the changes, you may terminate the Agreement by ceasing to use the Add-ins and Plug-ins. If you do not object to the amended Terms, this will be deemed acceptance of the changes.
9. Additional information
1. For all other conditions (e.g. withdrawal, consumer information, etc.), only the terms and conditions of the main product apply. For the "CIB pdf brewer", please note the separately linked conditions.
2. The exclusive place of jurisdiction arising from or in connection with these provisions is Munich, Germany, if you are a merchant, a legal entity under public law or a special fund under public law.
3. If these Terms of Use are in a language other than German, these are translations. In the event of any conflict between these Terms of Use in English and the Terms of Use in any other language, the provisions in English shall take precedence over the other language versions and supersede them in the event of a conflict.
